Product Return Policy

SATISFACTION GUARANTEED
If you receive your GPS equipment and decide within 20 days of receipt that you do not wish to keep it, we will accept returns for credit or exchange for any item (except software-see below) returned in as-new condition, if you have contacted us within the 20 days for a return authorization (see below).  A restocking fee will be applied in some instances (see below). The refund will not include any shipping charges - you are responsible for return shipping charges (in both directions and including any applicable brokerage charges). Please send the item back using Fedex.  

SOFTWARE ITEMS
Any non-defective software that has been opened is not returnable under any circumstances.  If you open software, you are agreeing to the license agreement established by the software publisher.  Be sure to read and agree to the license before using the software.

DEFECTIVE ITEMS & RETURNS
Inspect your order when you receive it. If you find that your product has an operating problem or is defective, we will exchange that equipment for a new item within 15 days of your receipt. Defective software products may be exchanged for the same title.
Before requesting the return of a defective GPS, GPS accessory, or software you must first contact the manufacturer to see if the problem can be remedied through technical support. If the manufacturer’s tech support staff cannot resolve the problem then you may email us to request a "Return Number". If you have equipment problems after 15 days, please contact the manufacturer directly for warranty repair.
 

We do not have any obligations in providing any technical support on the product. Please contact the manufacturer directly for technical and product assistance.

 

Drivers: Units and software may come with a CD with drivers for common operating systems and hardware. We cannot guarantee that the CD will have the proper or latest driver for all systems. If a driver does not exist on the CD because you have an old system or an uncommon system or for whatever other reason, then this is not considered a defect. The manufacturer will have a tech support department for this and it is the customer's responsibility to contact them. Getting the proper or latest drivers is typically a short and easy process that takes a mere few short minutes.


RETURN PROCEDURES
Please call us for a "Return Number Authorization". Return requests for items that are not defective, or are done after 30 days from receipt, or without a return authorization, will be charged a $40 restocking fee. The RA number must appear clearly on the shipping box, or shipping label of the return shipment, and on a copy of your Invoice enclosed with the return.  Please do not use the product box itself as your shipping package. Once we receive your return, we will issue a refund by mail or original credit card. 

 

Do not try to send your return before contacting us.  Your item could end up going to the wrong warehouse location for that particular item and you will incur additional shipping costs to yourself since we will have to forward the item to the correct location at your expense.  (And once again, items sent without an RNA will be charged a restocking fee.)

 

Depending on your financial institution, it may take up to 10 days or more for the refund credit to appear in your account.

As-new condition means that all data must be purged and the product must be returned with the original packaging and accessories.  Items that are damaged, or are not in as-new condition will be charged a $40 restocking fee. All packaging, manuals and original accessories must not be marked or damaged in any way. We reserve the right to refuse a return on any product that
does not meet these requirements.
 

Unauthorized returns will be shipped back to the purchaser at the purchaser's expense. Unauthorized returns will be subject a storage fee of $2.00 per day until return postage can be arranged by the purchaser. Return postage fees must be via courier and include shipping, handling, tracking, and insurance, and must be paid by either Cashier's Check or Money Order as we will not accept credit cards for return shipping on unauthorized merchandise returns. Unauthorized returns will be donated to charity if storage fees exceed the purchase totals.
 

A 50% restocking fee and applicable freight & brokerage charges in both directions is applicable to any discontinued item.

 

Restocking fee is per item.


ORDER STATUS

If you are inquiring regarding an order you placed, for a faster response please indicate in your email the item you ordered and the date you ordered it.
 

Items ship quickly and often your order may be shipped and delivered before you receive an update on your order.


It is important that you provide us with your phone number at the time of purchase so that we can provide this to the courier in case they have trouble delivering items.

Make sure your spam filters on your incoming email do not block any emails from us to you.

Delays however uncommon, can be due to manufacturer's back order, difficulty in security and or address verification, pay by check or echeck processing, high shipping volumes due to holidays, storm activity, custom's delays on international orders, etc.

 

MightyGPS is not responsible for shipping delays that are a result of the shipping company (FedEx, DHL, UPS, USPS, or other). Also, the customer is responsible for filing any claims with the courier should any package be lost, damaged, delayed, or stolen while in transit.

If you were quoted a shipping time keep in mind it is an average or approximate shipping time. We cannot absolutely guarantee shipping times.

Note that customers are responsible for any brokerage charges couriers may apply for items crossing international borders.

Note that our Canadian warehouse only stocks our most popular items and so other items may ship from our US based facilities.
 

We deliver via courier so please be available to sign for your package or have it delivered to someone or some place that it may be signed for.

 

We do not process orders during weekends / national holidays. We do not guarantee the item will ship out the same day you order.


CANCELLATIONS
Orders must be cancelled via email. Cancellations will not be accepted by phone.

Your order may be cancelled at any time with the exception of the Following. Once your order has shipped it is not able to be cancelled , its already on its way to you... so enjoy it!

Refused shipments will be subject to 20% restocking fee and applicable freight & brokerage charges in both directions.

ONLINE ORDER ERRORS
If you have submitted an order in error online - please email us so that it can be corrected before it ships! If your not sure about what is the correct item please call or email us before you submit your order!
 

Other shipping considerations:
APO and FPO destinations:

We use the US Postal Service for APO and FPO destinations since couriers will not deliver to these. Please note that due to the inability of the USPS to track shipments to final APO/FPO addresses, MightyGPS liability for shipments ends when the goods leave our facilities.
 

Orders outside of North America: In some cases Extended area delivery surcharges may apply.

 

Non-deliverable shipping addresses:
In the event that your order has shipped and contains erroneous shipping address information (provided by you at the time of order) so that the shipper cannot deliver the shipment, we will attempt to correct the address information and reroute the package to you. This may cause a delay in the shipping time and any additional charges incurred will be charged to you in addition to the 20% restocking fee.

 

We currently do not ship to Post Office Boxes as couriers will not deliver to them.

 

If you provide us with incomplete/improper order info or an improper shipping address that we cannot ship to then we will try to contact you to get the missing info/address. If you pay an improper shipping amount then we will send a request for the remainder due. If we are unable to get the info or shipping amount we need from you to ship the item within a week then we may choose to simply refund you minus an administration fee of $15.

The shipment will be deemed to be non-deliverable if the shipping company (i.e. courier) states that there is a problem with the address or such. It is your responsility not ours to work things out with them if you disagree about the validity of your address and such.  We will not act as your personal advocate or some kind of postal ombudsman. 

 

Refused Shipments: The quickest way for us to process a return for you is for you to accept delivery and then contact us about sending the item back. If you refuse shipment, the product goes back to the delivery company and might not get back to us for a couple of weeks. We cannot process your return until we receive the product so we recommend that you accept delivery of the product and then contact us immediately for a Return Material Authorization (RMA) number.

 

Unjustified Chargebacks: If you initiate a chargeback with your credit card company or PayPal for an order that you placed and received without attempting to resolve the issue with us first as per our service policies, you will be assessed a $50 fee to covers the time and expense that we have to invest in investigating and proving that you made the purchase, received the item, and failed to make proper efforts to resolve the problem with our company. Unpaid chargeback fees will be referred to a collections agency. Chargebacks that appear to be motivated by fraud (i.e. cashing a refund check AND filing a chargeback, or false claims of non-receipt of merchandise) will be immediately referred to law enforcement for investigation and prosecution. Customers are out top priority so if there is any problem with the order contact us first and we will do everything we possibly can to fix it. However, if you use a credit card chargeback, PayPal dispute, or some other hostile remedy as your first choice for problem resolution, we will respond appropriately.
 

If a dispute is issued for any transaction the card holder or individual placing the order will be liable for but not be limited to any and all costs, fees, civil, legal, and administrative to settle such dispute.

We will not be liable for any personal injury, physical injury, and/or damage caused by the product. Under NO circumstances, including, but not limited to, negligence, shall MightyGPS be liable for any direct, indirect, special, incidental or consequential damages, arising out of use, misuse, or inability to use, items or services purchased from MightyGPS. For safety handling and operation on the product, please consult the item's user manual or contact the manufacturer directly.

 

MightyGPS reserves the right to make changes to this site and to these terms and conditions at any time without notice.

 

It is the responsibility of the Buyer to ascertain and comply with all applicable laws in regard to the possession and use of items they have purchased.  By placing an order, the Buyer represents that he/she is of legal age and agrees to use the product only in a lawful manner.

 

Deactivation Policy on realt time tracking service:
* Service is billed for every month. In order to deactivate devices, the billing party must send an emailed cancellation note to david@mightytracker.com before the 14th of the month at 4:00 PM Eastern Standard Time. Failure to meet this deadline will result in an additional month of service billed.
